Terms of Service

These Terms govern your use of Decode, a forensic YouTube analytics service operated by Nicholas Ayers, sole proprietor, doing business as Decode (“we”, “us”). By creating an account or using Decode, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Decode.
1. YouTube API Services
Decode uses YouTube API Services. By using Decode, you agree to be bound by the YouTube Terms of Service. Google's handling of your data is described in the Google Privacy Policy. You may revoke Decode's access to your YouTube data at any time through the Google security settings page at https://myaccount.google.com/permissions.
Decode is not affiliated with, endorsed by, or sponsored by YouTube or Google. Metrics and estimates that Decode produces from its own analysis are ours, not YouTube's, and are labeled as such in the product.
2. Your account
You must be at least 18 years old and able to enter a binding contract. You are responsible for activity under your account and for keeping your credentials secure. You may only connect YouTube channels that you own or are authorized to manage. One account is for one person or entity; do not share access credentials.
3. What you may and may not do
- Do not attempt to access data belonging to channels you do not own or manage.
- Do not scrape, resell, redistribute, or sublicense Decode's outputs as a competing analytics product.
- Do not reverse engineer, interfere with, overload, or attempt to circumvent limits on the service.
- Do not upload content you do not have the right to upload, or content that is unlawful.
- Do not use Decode in any way that violates the YouTube Terms of Service or the YouTube API Services Developer Policies.
4. Your content
You keep ownership of the scripts, titles, thumbnails, audio, and other content you submit. You grant us a limited license to process that content solely to provide the service to you — to generate analysis, predictions, and recommendations for your account. We do not use your content to train generalized AI models, and we do not publish it.
5. Predictions are estimates
Decode produces statistical estimates based on your own historical channel data. They are not guarantees of performance. YouTube's systems, your audience, and market conditions change, and outcomes will vary. You are responsible for your own publishing decisions. Decode reports its own accuracy against locked predictions so you can judge how much weight to give it.
6. Beta access
Decode is currently in closed beta. Access is granted by approval, is provided free of charge unless we agree otherwise in writing, and may be modified or withdrawn at any time. Beta features may change or be removed.
7. Subscriptions and payment
When paid plans launch, they will be billed in advance on a recurring basis through our payment processor. Fees are non-refundable except where required by law or where we state otherwise in writing. You may cancel at any time; cancellation takes effect at the end of the current billing period. We may change pricing with at least 30 days' notice before it applies to your next renewal.
8. Availability and changes
We may modify, suspend, or discontinue features at any time. Decode depends on third-party APIs, including YouTube's; if those change or become unavailable, affected features may change or stop working.
9. Termination
You may stop using Decode and delete your account at any time. We may suspend or terminate your account if you breach these Terms, if required by law or by Google or YouTube policy, or if your use threatens the security or integrity of the service. On termination, your data is handled as described in the Privacy Policy.
10. Disclaimers
To the fullest extent permitted by law, Decode is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to Decode is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
12. Indemnity
You agree to indemnify and hold harmless Nicholas Ayers, sole proprietor, doing business as Decode from claims arising out of your use of Decode, your content, or your breach of these Terms or of the YouTube Terms of Service.
13. Governing law
These Terms are governed by the laws of Arizona, United States, without regard to conflict-of-law rules. Disputes will be brought in the courts located in Arizona, United States.
14. Changes to these Terms
We may update these Terms. Material changes will be announced by email and in the product before they take effect. Continuing to use Decode after that means you accept the updated Terms.
